These Terms of Service ("Terms") govern your access to and use of the LOQATE platform and related services provided by LOQATE ("we", "us", "our").

By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, you may not use the platform.

LOQATE provides a cloud-based fleet management platform that includes real-time GPS tracking, trip detection, vehicle analytics, geofencing, and related services.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with reasonable notice where practicable.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must provide accurate and complete information when creating an account. You agree to notify us immediately of any unauthorised use of your account.

You are responsible for ensuring that all GPS devices registered to your account are used in compliance with applicable laws, including data protection and privacy regulations.

You agree to use the platform only for lawful purposes and in accordance with these Terms. You may not use the service to track individuals without their knowledge or consent where required by law.

You may not attempt to reverse-engineer, decompile, or disassemble any part of the platform, or access the service through automated means at a scale that disrupts normal operation.

You may not use the platform to store or transmit malicious code, or to interfere with the integrity or performance of the service.

You retain ownership of all telemetry data, vehicle information, and other content you submit to the platform. We do not claim any ownership rights over your data.

By using the service, you grant us a limited licence to process your data solely for the purpose of providing and improving the platform.

Certain features of the platform may require a paid subscription. Pricing and payment terms will be set out in your service agreement or on our website.

All fees are non-refundable except as required by law or as explicitly stated in your service agreement.

To the maximum extent permitted by law, LOQATE shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.

The platform is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

Either party may terminate the agreement at any time by providing written notice. Upon termination, your access to the platform will cease and we will retain your data for a reasonable period to allow you to export it.

We may suspend or terminate your access immediately if you breach these Terms or if required to do so by law.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on our website. Continued use of the service after changes constitutes acceptance of the revised Terms.
